An innocent man should not hesitate to accept such an agreement. If he would not isn't that essentially admitting that things probably will be uncovered that are NCAA violations....not trivial stuff. In fact, the wording could be that if anything reported by ESPN turns out to be true you will be fired for cause. That limits SM's financial liability to the present situation.
