This makes sense to me but I wonder if there would be Title IX issues if say the women's soccer team played in Ohio based conference while basketball played in a different league

I believe Title IX only requires equal numbers of scholarship opportunities. As it is now, UD football competes in a different conference, albeit for reasons different than this discussion.

Title IX does not require parity. It is possible to satisfy Title IX by meeting the athletic demands of its students. Their can be a disparity in scholarships if there is unequal demand.

It’s measured by student interest. It’s a cool way to satisfy Title IX. If not for football, I think this would be more common.
