Girl involed with Pierre grad from UD 12/19
Per Tom Archdeacon DDN today
"...the femaile student invloved in this situation (Pierre) graduated Sat and her father posted a photo of her and UD pres. Dan Curran joyously embracing on the UD Arena stage".
I thought she transferred to tOSU.
If still at UD should she not have been suspended for one semester?
I thought if two UD students had been drinking and engage sexual activity
they were to be suspended per UD student code.

Okay, not taking a side here, well, I'm on DP's side actually. But I thought it all came down to "consent". While I believe they both gave consent from what I've read, it's kind of obvious they both can't be non-consenting and the act still take place.

I'm staying neutral on who was innocent or guilty in this case, but I just want to say that in some cases at other schools where the accused male was found to be innocent, the female accusers at other schools were not punished either, so UD might apparently have followed the same procedure that other schools have followed.

No she did not transfer and I heard she also worked at UD this semester. Did you not know that women have to take no responsibility for their actions? I believe one of UD's arguments for his suspension was that he would be a "danger" to her if he was on campus at the same time, thus the date of 12/20. It was OK that they were on campus together while UD took their sweet time to hold the hearings.
BTW, last night a little after 6pm, I saw Dan Curran on the floor near the tunnel. He embraced Dyshawn and talked to him for a while. I was more than a little surprised. Wish I had a camera with me, I could have posted that shot.

I saw the interaction as well. My interpretation is a little different. I'd say they appeared to "talk" for 30sec or so, but during the entire interaction Pierre's body language made him seem "uninterested and distant". Curran appeared to initiate a hug in the beginning, however after that DP wouldn't really make eye contact with him and was fidgety, like he was anxious to walk away. At the end of the convo I snapped this pic...

I agree it is time to move on but I think Tom Archdeacons revelation today shows us that UD did what they did for POLITICAL CORRECTNESS and continue protection/reception of TITLE IX money. For this I am truly disappointed in my alma mater.
Enforce the UD student code on well recognized D. Pierre.....let the unknown (to most of the general public) girl walk.
I ask anyone on this forum to tell me you think UD handled this situation correctly.

Two men hugging is perfectly ok and is politically correct so long as they both consent. Preferably in writing so there are no subsequent complaints filed when one suffers a period of hugger's remorse.

There were no females involved so the school, title IX etc could care less.
BTW I am one of the few who do not know who the girl is, nor do I want to, but one of my HR friends mentioned that this will follow her in the business world where title IX does not exist. She also noted that all females do not necessarily agree with the equal but not syndrome that has permeated the college campuses today. She went on to add that it isn't rocket science what went on there and some businesses may shy away from what could bed construed as a trouble maker. As she put it, we take sexual harassment very seriously but afford all parties due process.

Can Pierre get a restraining order placed on Dr. Dan? If I were suing someone, and someone tried to affect the way I felt about them by hugging them, perhaps in the hope I would drop the lawsuit, I'd at least consider a restraining order.

I have no real strong opinion on Dr Dan, but I am not sure you can paint him as the bad guy in this. Once it got to the title nine person, his hands were likely tied..... One could just as easily see his gesture last night as being an honorable one.

Yes and no on painting Dr. Dan as the bad guy.
Do we even know for a fact Dr. Dans hands were tied by title IX, or is it strictly the universitys kangaroo court that botched this. Honestly, it does not matter at this point, as in either case, even Title IX, Dr. Dan could have taken a stance for what is right and spoke up. Not just on this case, but other similar cases that may have happened at the U.
Rules are made to be broken, or in this case seriously amended. As the President of the University of Dayton, Dr. Dan could have been the Rosa Parks of Title IX reform.

Seems to me we're all guessing re the Title IX connection to this matter. Isn't it possible the U knows more about this than we do?
I don't see any connection to Title IX in this "he said, she said" matter,......absent a pattern of similar instances that were overlooked by the U.
If the accuser can point to a pattern of instances similar to hers for which the U looked the other way, then there is an issue. If that is not the case I don't see how Title IX has anything whatsoever to do with this.

If university Title IX people were involved in this matter... and there is no evidence of a pattern of the U ignoring or treating lightly situations like the one in question....then this was not a Title IX issue and the U mishandled it badly.

It is really not hard to see…. don’t make stuff up to support you view! Once the title nine rep was involved, he/she MUST follow the process defined in the school’s rules. Any attempt by anyone – Dr Dan, the AD, the coach, or anyone else – would be viewed as a violation. The “process” (no matter how flawed or improper we may feel it is) simply must be allowed to play out. I believe that is what happened. I don’t like it, but that is the way it is!
Now, can we please let all this go and move on! Very happy to have Dyshawn back!

IMHO:
-Title IX started as a worthy and noble initiative, but has become an excuse for "pitchfork and torch" brigades to head their ugly rears.
-Dr. Curran, at this stage of his career, has neither the desire nor the projected longevity to fight a "statement" case against any Title IX-imposed inequities.
-Whether he said it or not, Dr. Curran's gesture toward Pierre last night was an attempt for him to say, "My hands were tied. I'm sorry."
-If this situation had happened when I was a Junior at UD 32 years earlier, the discipline leveled at each "participant" would have been minor, and all parties would have moved on.
-Someone, somewhere, at some point in time, is going to have to force the pendulum to swing back to a point of relative equilibrium between the rights of the accuser and the rights of the accused.
-As far as we know, no one at UD is likely to be that "someone", UD is probably not that "somewhere", and Now is probably not that "some point in time".
Lots of blame to go around. H@!!, blame me, if it makes you feel better. At this point, let's just move forward, and use this as a lesson for future reference.

I'm a 55 year old female. Graduated from high school in 1978 -- right in the middle of the initial Title IX directives. I was the only girl in a family of 4 kids -- 3 brothers that all got full ride football scholarships that paid for their college education. I went to college and piled up lots of student loan debts my brother never had to start life with. We were a very middle class family headed by a high school football coach, so my parents did not have the means to pay for any of our college educations.
I've been a big fan of Title IX my entire adult life. Four of my nieces got their college education paid for because of Title IX, including one that played volleyball at Dayton.
I have been SHOCKED at the recent news coverage regarding how this bill is forcing colleges to react in fear of losing Federal funding if they support a male student that has been accused of sexual misconduct. In general terms, this is so wrong. Due process and the constitution apparently be ****ed. Unfortunately it's probably going to take a son of a parent that has connections to a law maker in Washington that gets caught in this web -- or a son of a high-powered lawyer that can handle the legal battle to get this law changed. The average parent of these men being kicked out of schools don't have unlimited financial resources to fight this legal battle all the way to the Supreme Court because that's probably where it would be decided.
The only other option I can see is a group of universities banning together either in the courts or in lobbying congress to get this changed. Who knows if that's going to happen?? I think we are going to see a bunch more of these incidents at schools. In other words, prepare yourself for more young men getting railroaded out of schools without due process.

Dr. Dan is on his way out, he slept walked through this summer plain and simple. If he truly looked at the facts, and acted in a timely manner none of this crap happens.
It happened in APRIL. If he wasn't on some trip in his mind somewhere, he could have called Pierre in, told him he can go to classes in the summer and will be suspended four games for a "conduct violation" and then one of our finest citizens to play on and off the court at Dayton and team captain could have f'n graduated on time and played. No lawsuits, no issues, no nothing .... But yet none of that happened. In general terms, this is so wrong. Due process and the constitution apparently be ****ed. Unfortunately it's probably going to take a son of a parent that has connections to a law maker in Washington that gets caught in this web -- or a son of a high-powered lawyer that can handle the legal battle to get this law changed. The average parent of these men being kicked out of schools don't have unlimited financial resources to fight this legal battle all the way to the Supreme Court because that's probably where it would be decided.
The only other option I can see is a group of universities banning together either in the courts or in lobbying congress to get this changed. Who knows if that's going to happen?? I think we are going to see a bunch more of these incidents at schools. In other words, prepare yourself for more young men getting railroaded out of schools without due process.

No one player, or group of players, or university will have a chance of stopping this injustice. By this time the powers-that-be at Title IX are patting each other on the back and circling the wagons. Dyshawn Pierre is but a spit in the eye to them. This momentum against college males is fixing to get a whole lot more invasive and powerful.

I read the article and maybe it's just me but something kind of stood out to me (totally unrelated to the gist of the Newsweek article). In one picture laced in the article, it showed the girl apparently walking the campus with books in one hand and carrying the mattress in the other hand over her head (which appeared to be a single size mattress - which I'm not sure I could even do). Yet later on in the article, it shows her in the line at her commencement ceremony being "helped" by 3 other young women friends to carry the mattress. Why did she need help? Was it due to the fact that at the graduation ceremony she used a "real" box-spring mattress (which likely weighed 30-50 pounds) but when she walked around campus she used an "air" mattress that weighed less than 5 pounds? Does that make any sense? Wasn't the whole point of her campaign to "carry that weight"? Seems like she might have been cheating on the campaign...I don't understand why she needed help at graduation time to "carry that weight" - even if it was a real mattress the whole time. Shouldn't her arm muscles be well developed and used to "carrying that weight" by the time she graduated? Why did she need help? I don't get it. Unfortunately, this is how my brain is wired nowadays and I pick Christmas day morning to voice the opinion...

Since you give me permission and blessing, one last comment...
The campaign the young lady in the article ran (with apparently the help of a professor) was "carry that weigh" which seems to also be borrowed to put it lightly, from the Beatles Abbey Road album. Seems to me there could be some copyright infringement going on here...wonder how the surviving Beatles would feel about this if they haven't given permission to use that slogan...
